Welcome to Interviewer.AI for Mock Interviews!

These Terms of Use and Privacy Policy (“Terms”) govern your access to and use of the Interviewer.AI platform and services specifically for the purpose of conducting mock interviews to practice and prepare for real job interviews (“Platform” or “Service”). The Platform is operated by Interviewer.AI Pte. Ltd. (UEN 201837827Z), a company incorporated in Singapore (“Interviewer.AI”, “we”, “us”, or “our”).

IMPORTANT: For the purpose of using our Platform for mock interviews, YOU are the Data Controller of the Personal Data you provide and generate (such as video recordings of your mock interviews, your responses, and any documents you upload for practice). Interviewer.AI acts as a Data Processor on your behalf, processing this data solely to provide you with the mock interview Service as described in these Terms.

By accessing or using the Platform for mock interviews, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

  1. Definitions

For the purposes of these Terms, the following capitalised terms shall have the meanings set out below:

  • “User”, “you”, or “your” means an individual who registers for an account on the Platform to conduct mock interviews for practice and self-assessment. For the purposes of data protection laws applicable to your mock interview data, you are the Data Controller.
  • “User Account” means the account you create to access and use the Platform for mock interviews.
  • “User Content” means all content, materials, and information uploaded, submitted, recorded, generated, or otherwise made available on the Platform by you in the course of your mock interviews. This includes, but is not limited to, your video and audio recordings, text responses, résumés or CVs uploaded for practice purposes, and any other data you provide. You are the owner and Data Controller of your User Content.
  • “Interviewer.AI”, “we”, “us”, or “our” refers to Interviewer.AI Pte. Ltd. For the purposes of data protection laws applicable to User Content, Interviewer.AI is the Data Processor.
  • “Personal Data” means any data, whether true or not, that relates to an identified or identifiable natural person. This includes data you provide during registration and User Content that may contain personal information. This definition incorporates the meaning of “personal data” or “personal information” under applicable Data Protection Laws.
  • “Platform” means the Interviewer.AI software platform, including our website, applications, APIs, tools, and features, as made available for the purpose of conducting mock interviews.
  • “Data Protection Laws” means all applicable laws and regulations relating to the protection of personal data and privacy, including but not limited to Singapore’s Personal Data Protection Act 2012 (“PDPA”), the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the UK General Data Protection Regulation (“UK GDPR”), the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”), India’s Digital Personal Data Protection Act, 2023 (“DPDP Act”), and relevant data protection laws in African jurisdictions (such as South Africa’s Protection of Personal Information Act (“POPIA”) or Nigeria’s Data Protection Regulation (“NDPR”)).
  • “Intellectual Property Rights” means all rights, title, and interest in and to patents, copyrights, trademarks, service marks, trade names, design rights, database rights, trade secrets, know-how, and other proprietary or intellectual property rights (whether registered or unregistered), and all applications, renewals, and extensions thereof, in any jurisdiction.
  • “SIAC” refers to the Singapore International Arbitration Centre.
  • “SIMC” refers to the Singapore International Mediation Centre.
  • “Assessment Report” refers to the detailed report provided to you after completing a mock interview, outlining your performance against various parameters analyzed by our AI models.
  1. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in legal requirements, business practices, or Platform functionality. Where changes are material, we will notify you by reasonable means, which may include email (to the address provided at registration) or a notice posted on the Platform. Unless otherwise stated, updates become effective upon notification. Continued use of the Platform after such changes have been made constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

  1. Eligibility and Account Registration

3.1. To register for a User Account and use the Platform, you must be at least eighteen (18) years of age, or the age of majority in your jurisdiction if different. 3.2. You will be required to provide certain information to create your User Account. You represent and warrant that all information provided by you is true, accurate, current, and complete. You agree to promptly update your information as necessary. 3.3. You may terminate your User Account at any time by following the instructions on the Platform or by notifying us in writing. Upon termination, your right to access and use the Platform ceases.

  1. Password and Account Security

4.1. You are responsible for maintaining the confidentiality of your login credentials (e.g., password) and must not disclose them to any third party. 4.2. You are solely responsible for all activities that occur under your User Account, whether authorised or unauthorised. 4.3. You must notify us immediately at [email protected] if you become aware of or suspect any unauthorised access to your User Account. 4.4. Interviewer.AI reserves the right to request a password reset or suspend your account if we have reason to believe it has been compromised, pending investigation.

  1. Your Role and Responsibilities as a User and Data Controller

5.1. Data Controller: For all User Content you create, upload, or generate during your mock interviews (including video/audio recordings, text inputs, and uploaded documents), you are the Data Controller. This means you determine the purposes and means of processing this Personal Data. 5.2. Lawful Use: You are responsible for ensuring that your collection and use of any Personal Data within your User Content complies with all applicable Data Protection Laws and respects the privacy rights of any individuals whose data you might include (e.g., if you discuss a real person in a mock scenario). 5.3. Instructions to Processor: By using the Platform, you instruct Interviewer.AI (as Data Processor) to process your User Content solely for the purpose of providing the mock interview Service to you, as further detailed in these Terms.

  1. Use of the Platform for Mock Interviews

6.1. License: Interviewer.AI grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for your personal, non-commercial purpose of conducting mock interviews, practicing, and self-assessment. 6.2. Consent to Recording: The Platform’s core functionality involves recording your mock interview responses (video, audio, and text). By using the Platform, you expressly consent to such recording and to the processing of this User Content by Interviewer.AI (acting as your Data Processor) to enable you to review your performance, receive AI-generated feedback and your Assessment Report (if such features are offered and you choose to use them), and manage your mock interview data. 6.3. Prohibited Uses: You agree not to use the Platform: a) For any unlawful, fraudulent, or malicious purpose; b) To create or disseminate content that is false, misleading, defamatory, obscene, offensive, threatening, or otherwise objectionable, or that infringes on the rights of others; c) To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; d) To reproduce, sell, resell, or commercially exploit any part of the Platform (excluding your own User Content, of which you are the controller); e) To reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Platform; f) To interfere with the access or use of the Platform by other users; g) To gain unauthorised access to data, systems, or accounts; h) To transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature; i) In any manner that violates these Terms or applicable laws. 6.4. Interviewer.AI reserves the right to investigate and take appropriate action, including suspension or termination of your User Account, if we reasonably believe you have violated these Terms.

  1. User Content (Your Mock Interview Data)

7.1. Ownership and Control: You retain all ownership rights and are the Data Controller of your User Content. Interviewer.AI does not claim any ownership rights in your User Content. 7.2. License to Interviewer.AI (as Data Processor): By submitting, uploading, or generating User Content on the Platform, you grant Interviewer.AI a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, adapt (e.g., for formatting), display (solely to you), and use your User Content. This license is strictly limited to the purpose of: a) Operating and providing the mock interview Service to you; b) Enabling you to access, review, and manage your User Content; c) Providing you with features you elect to use, such as AI-driven feedback and your Assessment Report (where applicable); d) Performing necessary technical functions, such as backups, security measures, and troubleshooting. 7.3. Responsibility for User Content: You are solely responsible for your User Content and the consequences of creating, posting, or publishing it. You represent and warrant that you have all necessary rights, licenses, and consents to use and share your User Content as contemplated by these Terms and that your User Content does not infringe the rights of any third party or violate any laws. 7.4. No Monitoring Obligation (Generally): Interviewer.AI generally does not monitor or review User Content. However, we reserve the right (but not the obligation) to remove or disable access to any User Content that we, in our sole discretion, believe violates these Terms or applicable law, or if required by legal or regulatory authorities.

  1. Interviewer.AI’s Role as a Data Processor

8.1. When processing your User Content, Interviewer.AI acts as a Data Processor on your behalf, pursuant to your instructions as the Data Controller (as set out in these Terms). 8.2. Interviewer.AI will only process User Content to provide the Service and in accordance with these Terms and any lawful instructions you provide through the Platform’s functionalities. 8.3. We will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of processing your User Content (see Section 9.6 “Data Security”). 8.4. We will assist you, where reasonably possible and at your expense if significant effort is required, in fulfilling your obligations as a Data Controller under Data Protection Laws (e.g., responding to data subject rights requests related to User Content you control). 8.5. We will notify you without undue delay upon becoming aware of a personal data breach affecting your User Content. 8.6. Upon termination of your User Account, or at your request, we will delete or return your User Content in accordance with Section 9.7 (“Data Retention and Deletion”). 8.7. Sub-processors: You acknowledge and agree that Interviewer.AI may use third-party sub-processors to process User Content. These include, but are not limited to: * Cloud hosting providers (e.g., AWS or Google Cloud). * AI service providers for feedback features, such as OpenAI or Google Gemini, for their Generative AI capabilities to provide feedback on your mock interviews and generate parts of your Assessment Report. We will maintain a list of our key sub-processors, available upon request or on our website, and will ensure that any sub-processors are bound by contractual obligations comparable to those imposed on us as a Data Processor under these Terms and Data Protection Laws. We remain responsible for the acts and omissions of our sub-processors.

  1. Privacy Policy

This section outlines our commitment to your privacy and describes how we handle Personal Data in the context of your use of the Platform for mock interviews.

9.1. Our Commitment to Your Privacy Interviewer.AI is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your Personal Data when you use our Platform for mock interviews. As stated, for your User Content, you are the Data Controller, and we are the Data Processor. For data related to your User Account management and our direct interactions with you (e.g., service emails, platform usage analytics not part of User Content), Interviewer.AI may act as a Data Controller.

Note: For data you submit in mock interviews (videos, documents, etc.), you are the Data Controller and Interviewer.AI is a Data Processor. For your account data and usage tracking, Interviewer.AI is the Data Controller.

9.2. Information We Process

  • A. User Content (Interviewer.AI as Data Processor):
    • Video and audio recordings of your mock interviews.
    • Text-based answers or notes you input.
    • Documents you upload for practice (e.g., CVs, job descriptions).
    • AI-generated feedback or analysis related to your mock interviews, which forms part of your Assessment Report (if applicable).
    • Any other Personal Data contained within the materials you use for mock interviews.
    • Purpose of Processing (as Data Processor): Solely to provide the mock interview Service to you as instructed, enabling you to practice, review, receive AI-driven feedback and your Assessment Report, and manage your User Content. We do not use this User Content for our own purposes beyond providing and improving the service directly to you or as aggregated and anonymized data for service improvement (see section 9.4).
  • B. Account and Usage Data (Interviewer.AI as Data Controller):
    • Registration Information: Your name, email address, password, and any other information you provide when creating your User Account.
    • Contact Information: If you contact us for support or inquiries.
    • Platform Usage Data: Information about how you use the Platform, such as features accessed, time spent, technical logs, IP addresses, browser type, device information, and cookies (see Section 9.9 “Cookies and Tracking Technologies”).
    • Communications: Records of communications with you (e.g., service announcements, support responses).
    • Purpose of Processing (as Data Controller):
      • To create and manage your User Account.
      • To provide and maintain the Platform, including technical support.
      • To communicate with you about the Service (e.g., updates, security alerts, delivery of your Assessment Report).
      • To improve our Platform and develop new features (often using aggregated and anonymized data).
      • To ensure the security and integrity of our Platform.
      • To comply with legal obligations.

9.3. Legal Basis for Processing Your Personal Data

  • For User Content (as Data Processor): Our legal basis for processing your User Content is the performance of our contract with you (these Terms) to provide the mock interview Service, including the generation and delivery of your Assessment Report, acting upon your instructions as the Data Controller.
  • For Account and Usage Data (as Data Controller):
    • Performance of a Contract: Processing necessary to create and manage your account and provide the core Platform services.
    • Legitimate Interests: Processing for purposes like improving our Service, security, analytics (where it does not override your fundamental rights and freedoms). We will only rely on legitimate interests where the processing is proportionate and necessary.
    • Consent: For certain types of processing (e.g., some cookies, optional marketing communications if any), we will obtain your explicit consent.
    • Legal Obligations: Processing necessary to comply with applicable laws.

9.4. How We Use and Share Your Information

  • User Content:
    • We do not share your User Content with third parties, except:
      • With our contracted sub-processors (e.g., cloud storage providers like AWS or Google Cloud, AI service providers like OpenAI or Google Gemini for feedback features and Assessment Report generation if you use them) who are bound by confidentiality and data protection obligations to process data only on our instructions.
      • If required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (i) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (ii) enforce our agreements with you; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of our Service.
    • We do not sell your User Content.
    • We do not use your User Content to train general AI models for other customers or third parties, unless we have obtained your explicit, opt-in consent for such specific use, or if the data is fully anonymized and aggregated such that it no longer constitutes Personal Data.
    • AI-generated analysis is conducted solely to deliver your personal Assessment Report and is not retained for training unless explicitly consented to.
    • Any AI features used to provide you feedback and generate your Assessment Report within your mock interview session are for your benefit as part of the Service.

  • Account and Usage Data:
    • We may share this data with:
      • Service providers who assist us in operating the Platform (e.g., hosting, analytics, customer support tools), under strict confidentiality and data processing agreements.
      • If required by law or legal process.
      • In connection with a merger, acquisition, or sale of assets, subject to confidentiality commitments.
    • We may use aggregated and anonymized Account and Usage Data for research, analytics, and to improve our services. This data does not identify you personally.

9.5. Your Rights as a Data Controller and Data Subject

You have certain rights regarding your Personal Data, subject to local Data Protection Laws. As the Data Controller of your User Content, you are primarily responsible for responding to requests concerning it. We will provide you with reasonable assistance. Your rights generally include:

  • Right of Access: You can access your User Account information and much of your User Content (including your Assessment Reports) directly through the Platform. You can request access to other Personal Data we hold about you.
  • Right to Rectification: You can update your User Account information. You can modify or re-record User Content as the Platform allows (though this may not alter previously generated Assessment Reports). You can request correction of inaccurate Personal Data we hold.
  • Right to Erasure (Right to be Forgotten): You can delete your User Account and specific User Content (including Assessment Reports) through the Platform. Deleting your account will lead to the deletion of your associated Personal Data, subject to our retention policies (see Section 9.7).
  • Right to Restrict Processing: You may have the right to request that we restrict the processing of your Personal Data under certain circumstances (e.g., if you contest its accuracy).
  • Right to Data Portability: Where applicable, you may have the right to receive your Personal Data (including elements of your Assessment Reports where technically feasible) in a structured, commonly used, and machine-readable format, and to transmit it to another controller.
  • Right to Object: You may have the right to object to processing based on our legitimate interests.
  • Right to Withdraw Consent: Where we process Personal Data based on your consent (e.g., for certain cookies or optional marketing), you can withdraw your consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.
  • Rights Related to Automated Decision-Making and Profiling: If we use automated decision-making (including profiling) that produces legal effects concerning you or similarly significantly affects you, we will provide meaningful information about the logic involved, as well as the significance and the envisaged consequences. You may have the right to obtain human intervention, express your point of view, and contest the decision. (AI feedback and Assessment Reports in mock interviews are generally for guidance and self-assessment, not binding decisions with legal effect).
  • Right to Lodge a Complaint: You have the right to lodge a complaint with a supervisory authority in your jurisdiction if you believe our processing of your Personal Data infringes applicable Data Protection Laws. (e.g., your local Data Protection Authority in the EU/UK, the Data Protection Board of India).

Specific Regional Provisions:

  • European Union (GDPR) & United Kingdom (UK GDPR):
    • Interviewer.AI Pte. Ltd. is the Data Processor for your User Content and Data Controller for Account and Usage Data.
    • Our DPO details are in Section 9.11.
    • If Personal Data is transferred outside the EEA/UK to countries not deemed adequate by the European Commission/UK Government (like Singapore), we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) or the UK’s International Data Transfer Agreement (IDTA).
  • USA (California – CCPA/CPRA & other states):
    • You have rights such as the right to know, delete, opt-out of sale/sharing (Interviewer.AI does not “sell” your Personal Data or User Content in the traditional sense of the CCPA. We do not share User Content for cross-context behavioral advertising).
    • We will not discriminate against you for exercising your CCPA/CPRA rights.
  • India (Digital Personal Data Protection Act, 2023 – DPDP Act):
    • We process your Personal Data based on your consent (deemed for voluntary provision of data for the service) and for the performance of our contract with you.
    • You have rights as a Data Principal under the DPDP Act (e.g., access, correction, erasure, grievance redressal).
    • Our Grievance Officer/DPO details are in Section 9.11.
  • Africa (e.g., POPIA in South Africa, NDPR in Nigeria):
    • We adhere to principles of lawful processing, data minimization, purpose specification, and security safeguards.
    • Cross-border transfers will be done in compliance with applicable requirements (e.g., consent, adequate protection in the recipient country).

To exercise your rights, please contact our Data Protection Officer (see Section 9.11). We will respond to your request in accordance with applicable Data Protection Laws. We may need to verify your identity before processing your request.

9.6. Data Security Interviewer.AI implements reasonable and appropriate administrative, physical, and technical safeguards designed to protect your Personal Data from unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks. These measures include encryption, access controls, and regular security assessments. However, no system can guarantee absolute security. You also play a role in protecting your data by safeguarding your password.

9.7. Data Retention and Deletion

  • User Content: We retain your User Content (including Assessment Reports) for as long as your User Account is active or as needed to provide you with the Service. You have direct control over your User Content and can delete specific items (e.g., individual mock interview recordings, Assessment Reports) through the Platform’s interface at any time. You can also choose to delete your entire User Account at will through the Platform. Upon termination or deletion of your User Account, all your associated User Content and Personal Data will be purged from our active systems and subsequently from backups in accordance with our standard deletion cycles (typically within 30-90 days), unless retention is specifically required for legal or regulatory compliance, dispute resolution, or to enforce our agreements.
  • Account and Usage Data: We retain Account and Usage Data for as long as necessary for the purposes outlined in this Policy, or as required by law. This may include retaining some data after account closure for legal, tax, or accounting purposes, or for security and fraud prevention.

9.8. International Data Transfers Interviewer.AI is headquartered in Singapore. Your Personal Data may be transferred to, stored, and processed in Singapore and other countries where we or our sub-processors operate. These countries may have data protection laws different from those in your country of residence. When we transfer Personal Data across borders, we take steps to ensure that the data receives an adequate level of protection in the jurisdiction to which it is transferred, such as by:

  • Relying on adequacy decisions from relevant authorities (e.g., European Commission).
  • Implementing Standard Contractual Clauses (SCCs) or equivalent contractual safeguards.
  • Obtaining your consent where required.

9.9. Cookies and Tracking Technologies We use cookies and similar tracking technologies (e.g., web beacons, pixels) to operate and administer our Platform, gather usage data, and improve your experience.

  • Essential Cookies: Necessary for the Platform to function (e.g., authentication, session management).
  • Performance & Analytics Cookies: Help us understand how users interact with our Platform, allowing us to improve its performance (e.g., Google Analytics).
  • Functionality Cookies: Remember your preferences and choices to provide a more personalized experience. You can control cookies through your browser settings. However, disabling certain cookies may affect the functionality of the Platform. We will seek your consent for non-essential cookies where required by law.

9.10. Children’s Privacy The Platform is not intended for use by individuals under the age of 18 (or the age of majority in their jurisdiction). We do not knowingly collect Personal Data from children. If we become aware that we have inadvertently collected Personal Data from a child, we will take steps to delete it.

  1. Mock Interview Assessment Report and Feedback

10.1. Assessment Report: Upon completion of a mock interview using the Platform, you will receive an Assessment Report. This report details your performance based on various parameters analyzed by our AI models. The purpose of the Assessment Report is to provide you with insights and feedback to help you improve your interview skills. 10.2. Parameters Analyzed: The Assessment Report includes scores and analysis for parameters such as, but not limited to, those detailed in the table below:

Overall Score

This is the final score which as a default is a combination of Resume Score, WorkMap Score and AI Video Score. However, the Overall Score can also reflect any one or any two of those scores as per settings.

Resume Score

This is the final percentage score of the resume based on relevance and comes directly from what is mentioned in the document uploaded as a resume by the applicant.

WorkMap Score

The WorkMap Assessment score is a final percentage score of the skills required for the job based on a likert scale. A Likert scale of agreeableness is commonly used to measure attitudes, knowledge, perceptions, values, and behavioral changes. A Likert-type scale involves a series of statements that respondents may choose from in order to rate their responses to evaluative questions (Vogt, 1999).

AI Video Score

The AI Video Interview Score is the final percentage score based on video responses recorded asynchronously by the candidate. It is commonly used as the first round of interview to give equal opportunity to every candidate using scientifically-proven structured questionnaires. The technology uses natural language processing, computer vision, and voice analytics to measure four traits: Professionalism, Positive Attitude, Communication and Sociability. The AI Video Interview Score helps reduce screening time by 80%, remove conscious and unconscious bias, and increase efficiency.

Response Relevancy

Measuring the relevancy of the content as mentioned by the candidate in their video responses. The questions follow a structured-interview technique where each question is designed to assess a skill using a behavioral and situational interview question. The Generative AI measures the relevancy of the response to the said question.

    Professionalism

It is measured from the applicant’s behavior (formal/informal) and looks at how the candidate presents himself/herself in the video. It also measures where eye contact is maintained during the video response, captures if there is any fidgeting at all.

  Dressing

This refers to your appropriateness and formality during the video interview. Your choice of clothing has a direct impact on this metric. This detects how formally you are dressed, so choose the right attire for the interview.

Grooming

This metric is focused on your hair tidiness, appropriate for video, during the video interview. Ensure you are well groomed for the interview.

Body Language

It is important to focus on body movement when we speak. The right amount of body gestures can be helpful to achieve a great score in this metric. This metric focuses on non-verbal gestures and communication through use of hands, shoulders, etc.

Positive Attitude

Attitude, as the name suggests, looks for sentiments along with a combination of energy and emotion. This model looks at a combination of metrics from communication and Sociability (for e.g. confident, encouraged, positive).

      Energy Levels

This metric is more inclined towards your perceived energy levels. This one focuses on your voice, which reflects your level of passion and excitement.

    Communication

This is primarily measuring the applicant’s clarity of speech. It also looks at verbal communication fluency and modulation of speech. Speaking clearly and with the right pace would be advantageous here. Variation in spoken pitch at appropriate times throughout the video would be beneficial.

        Articulation

This is primarily focused on the ability to speak with clarity, fluency. It measures the ability to express oneself in a clear and concise manner.

        Grammar

Evaluates the following: 1. Sentence Structure : Verify that the text contains grammatically correct and complete sentences. 2. Grammar Rules : Assess the text for proper usage of grammar, including verbs, tenses, conjunctions, prepositions, negation, etc. 3. Word Usage: Confirm that the text employs words in the correct context with accurate meanings. 4. Incomplete Sentences and Fillers: Ensure the text lacks incomplete sentences (Should not have incomplete sentences) or filler words such as “um” and “uh.”

        Sentiment

This metric focuses on your positive sentiments. Its always important to choose the right set of words during the conversation to score high on this one.

    Sociability

        Emotion

As the term refers to your emotional state. This is highly focused on your facial expressions. It is not necessary to smile throughout the interview but keep a positive or neutral expression.

        Sentiment

This metric focuses on your positive sentiments. It is always important to choose the right set of words during the conversation to show positive energy.

        Energy Levels

This metric is more inclined towards your perceived energy levels. This one focuses on your voice, which reflects your level of passion and excitement.

10.3. User Feedback: We value your input. You can share your feedback on the mock interview experience or the Assessment Report either directly on the Platform after your interview or after you receive the Assessment Report via email.

  1. Platform Availability

11.1. Interviewer.AI shall use commercially reasonable efforts to ensure the Platform is available. However, we do not warrant uninterrupted access, and the Platform may experience occasional disruptions or errors. 11.2. Access may be temporarily suspended for maintenance, upgrades, or technical issues. We will aim to minimize downtime.

  1. Intellectual Property Rights

12.1. Platform IP: All Intellectual Property Rights in and to the Platform itself—including text, graphics, logos, user interfaces, software, source code, object code, algorithms, and other proprietary content (excluding your User Content and your Assessment Report derived from your User Content)—are owned by Interviewer.AI or its licensors. You may not copy, modify, reproduce, distribute, publish, or commercially exploit any part of the Platform IP without our prior written consent, except as expressly permitted by these Terms or law. 12.2. User Content IP: You retain all Intellectual Property Rights in your User Content. Your Assessment Report is provided to you for your personal use.

  1. Third-Party Websites and Services

The Platform may contain links to third-party websites or services not operated by us. We are not responsible for their content, privacy practices, or security. Inclusion of links does not imply endorsement.

  1. Term and Termination

14.1. These Terms remain in effect as long as you use the Platform. 14.2. You may terminate your User Account and these Terms at any time. 14.3. We may suspend or terminate your access to the Platform with immediate effect if you breach these Terms. We may also terminate or suspend the Service for business reasons with reasonable notice where feasible. 14.4. Provisions that by their nature should survive termination shall survive, including: User Content (your ownership), Interviewer.AI’s Role as Data Processor (obligations regarding existing User Content until deletion), Privacy Policy sections (especially data retention and security), Intellectual Property Rights (Platform IP), Mock Interview Assessment Report and Feedback (your right to access previously generated reports subject to data retention), Limitation of Liability, Disclaimer, Indemnity, Governing Law, Dispute Resolution, and Miscellaneous.

  1. Disclaimer of Warranties

15.1. THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERVIEWER.AI EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. 15.2. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. 15.3. ANY AI-GENERATED FEEDBACK OR ANALYSIS PROVIDED IN THE ASSESSMENT REPORT IS FOR INFORMATIONAL AND PRACTICE PURPOSES ONLY AND IS NOT A GUARANTEE OF PERFORMANCE IN ACTUAL INTERVIEWS OR OF ANY EMPLOYMENT OUTCOME. INTERVIEWER.AI IS NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE BASED ON SUCH FEEDBACK.

  1. Limitation of Liability

16.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INTERVIEWER.AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM, ANY CONTENT THEREON, OR THE ASSESSMENT REPORT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 16.2. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED OR LIMITED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR THESE TERMS SHALL NOT EXCEED SINGAPORE DOLLARS ONE HUNDRED (S$100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. 16.3. This limitation of liability is a fundamental element of the basis of the bargain between you and Interviewer.AI. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

  1. Indemnity

You agree to indemnify, defend, and hold harmless Interviewer.AI, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: a) Your User Content (to the extent it infringes third-party rights or violates law); b) Your use or misuse of the Platform in violation of these Terms; or c) Your breach of these Terms or any applicable laws, including Data Protection Laws where you act as Data Controller.

  1. Governing Law

These Terms and any non-contractual obligations arising from or in connection with them shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.

  1. Dispute Resolution

19.1. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with its rules in force at the time. 19.2. The seat of arbitration shall be Singapore. 19.3. The tribunal shall consist of one (1) arbitrator. 19.4. The language of the arbitration shall be English. 19.5. You agree to attempt mediation at the Singapore International Mediation Centre (“SIMC”) in accordance with the SIAC-SIMC Arb-Med-Arb Protocol, if appropriate.

  1. Miscellaneous

20.1. Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction. 20.2. No Third-Party Rights: A person not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any term. 20.3. Waiver: Our failure to enforce any right or provision will not be a waiver of that right or provision. 20.4. Severability: If any provision is found unenforceable, the remaining provisions will remain in full effect. 20.5. Entire Agreement: These Terms constitute the entire agreement between you and Interviewer.AI regarding the mock interview Service and supersede all prior agreements.
